Fender, maker of the iconic Stratocaster guitar, has filed a lawsuit against Thomann, an instrument retailer, in a German court. The lawsuit alleges copyright infringement, with Fender claiming that Thomann's Harley Benton-brand guitars copy the classic Strat shape.

This development is not an isolated incident. In March, Fender secured copyright protection for the Strat in Europe, and in May, it sent cease-and-desist letters to various companies, including Yamaha, requesting they halt production and sales of Strat lookalikes bound for Europe. The Strat-shaped instrument has become ubiquitous, serving as the generic emoji symbol for "guitar" in most major operating systems.

The controversy surrounding Fender's efforts to enforce its copyright has sparked an online backlash among some guitar influencers. Thomann, however, has chosen a different path, filing a "declaration of non-infringement" against Fender in June. The company argues that Fender does not possess a valid copyright to the Strat body shape, citing the default judgment issued against a smaller online seller in March.

Fender's lawsuit this week presents a stark contrast to its earlier claims. In a statement, the company emphasized Thomann's size and stature as one of the world's largest musical instrument retailers and Fender's largest retail partners. "Thomann isn't a small independent guitar builder," Fender noted. "It is one of the world's largest guitar brands."

The stakes are high in this dispute. Fender sells approximately 500,000 Strats per year, with 34,000 of those sold in Germany alone. Thomann, meanwhile, reportedly sells 10,000 Fender Strats annually.

As the world of music and instruments continues to evolve, so too do the legal battles that shape its landscape. The Stratocaster, an iconic symbol of rock 'n' roll, has become embroiled in a complex web of copyright law, corporate interests, and artistic expression.
